This website is operated by Le Bon Wellness Pty Ltd (ABN 25 645 522 925), an Australian private company with its registered office at Suite 302, 55 Lime Street, Sydney NSW 2000, Australia.
Throughout the site, “we,” “us,” and “our” refer to Le Bon Wellness Pty Ltd.
We offer this website and all related information, tools, and services (the Services) to you, the user, subject to these Terms of Service (the Terms).
By using our website or purchasing from us, you agree to these Terms, our Privacy Policy, our Return & Refund Policy, and any other policies we reference. If you do not agree, please do not use the Services.
Our store is hosted by Shopify Inc., which provides the e-commerce platform we use to sell our products.
International compliance and your rights
We design these Terms to comply with consumer and privacy laws in the places we sell, including Australia (ACL, Privacy Act 1988 (Cth)), New Zealand (CGA, FTA, Privacy Act 2020), United States (FTC Act, CCPA/CPRA), Canada (PIPEDA), and the United Kingdom (Consumer Rights Act 2015, UK GDPR). Nothing in these Terms limits your statutory rights.
1. Eligibility and account
You confirm you are the age of majority in your jurisdiction, or you have consent from a parent or guardian for any minor who uses the Services under your supervision.
Keep your account details accurate. Keep your login secure. You are responsible for activity on your account.
2. Acceptable use
Do not use the Services for any unlawful or unauthorised purpose. Do not try to disrupt the site, probe systems, scrape content, send malware, or break intellectual property laws. We can suspend or terminate access if you breach these rules.
3. Information on the site
We aim to keep information accurate and current. Errors can happen. Content may change without notice. You use the site at your own risk.
4. Products, availability, and images
Some products are available in limited quantities or only online. Images and descriptions are for illustration and may differ slightly from the item you receive. We may limit sales or quantities, including by region.
5. Prices, currency, taxes, and duties

Charges appear in the currency for your delivery country at checkout. You are responsible for any taxes, duties, and import fees unless we state otherwise. Your card issuer may charge foreign exchange fees.
6. Orders and payment
When you place an order, you offer to buy products under these Terms. We may accept, reject, or cancel any order, including for suspected fraud, bulk orders, resellers, or pricing errors.
Payments are processed by third parties such as Shopify Payments, PayPal, or Stripe. Their terms apply. We are not responsible for issues caused by those services.
7. Subscriptions and recurring billing (if offered)

8. Shipping and risk of loss

9. Returns, refunds, and first order promise
Our Return & Refund Policy explains eligibility, timeframes, process, and our First Order Promise for single-unit products. That policy forms part of these Terms.
10. Promotions, gift cards, and credits
Promotions may have extra rules. We can change or end promotions at any time. Gift cards and credits are not redeemable for cash unless required by law and may have expiry dates where allowed.
11. User reviews and submissions
If you send us reviews, feedback, photos, or other content (Submissions), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit, publish, translate, and display those Submissions in any media.
Only post content you have the right to share. Do not post unlawful, misleading, or harmful material. We may remove content that breaches these Terms.
12. Intellectual property
All site content, logos, product names, graphics, and code are owned by us or our licensors and are protected by law. We grant you a limited, revocable licence to access the site for personal, non-commercial use. Do not copy, sell, resell, or exploit the Services without our written consent. BonPatch is our brand name. Do not add ™ to BonPatch in body copy.
13. Third-party services and links
We may link to or surface tools from third parties. We provide those as is. We are not responsible for their content or practices. Use them at your own discretion.
14. Wellness content and safety
Information on the site is general wellness information only. It is not medical advice and is not a substitute for professional care.
Do not use our products if you are allergic to any listed materials. Stop use if irritation occurs. If you have a health condition, are pregnant, or take medicines, talk to a health professional before use. Results vary.

15. Privacy
Your personal information is handled under our Privacy Policy. By using the Services, you consent to our data practices described there, including transfers to other countries where our providers operate.
16. Errors, corrections, and changes
We may fix errors or update content at any time, including after you place an order. We may modify or discontinue any Service without notice.
17. Fraud prevention and unauthorised returns
We may refuse, cancel, or review any order that appears fraudulent, unauthorised, or suspicious. Goods sent to correspondence addresses without a return authorisation will not be processed.

The Services and all products are provided “as is” and “as available”. We do not promise they will be uninterrupted, timely, secure, or error free. To the extent allowed by law, we disclaim all warranties, express or implied.
19. Limitation of liability
To the fullest extent allowed by law, we are not liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profits, revenue, data, or goodwill.
Liability cap: if we are found liable, our total liability is limited to the amount you paid for the product or service that gave rise to the claim. Some places do not allow limits like these, so your rights may vary.
20. Indemnity
You agree to indemnify and hold harmless Le Bon Wellness Pty Ltd and our officers, employees, partners, and service providers from claims arising out of your breach of these Terms or misuse of the Services.
21. Force majeure
We are not responsible for delays or failures caused by events outside our reasonable control, such as natural disasters, labour issues, network failures, or acts of government.
22. Governing law and venue
Nothing here limits your statutory consumer rights.

Australian residents or orders delivered to Australia: these Terms are governed by the laws of New South Wales, Australia, and the Australian Consumer Law.

United States residents or orders delivered to the United States: these Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law rules.
You agree that courts in the governing location above have jurisdiction, except where local consumer laws require a different forum.
23. Complaints and dispute resolution
Most issues can be resolved by contacting support@bonpatch.com. If we cannot resolve a dispute informally, you may have rights to bring a claim in your local small claims court where permitted by law.
24. Changes to these Terms
We can update these Terms at any time. We post the new date at the top of this page. Your continued use of the Services means you accept the changes.
25. Severability, waiver, and assignment
If any part of these Terms is unlawful or unenforceable, the rest stays in effect. If we do not enforce a right, we do not waive it. We may assign our rights and obligations. You may not assign yours without our consent.
26. Entire agreement
These Terms, together with policies we reference, are the entire agreement between you and us about the Services and supersede earlier terms.
